When I started practicing law in 1976 I often sought
the advice and counsel of experienced lawyers. My brother and I began representing clients and almost immediately had more questions about how much to charge rather than what laws applied to each particular problem. The thorniest area of legal fees was and is the cost of a divorce. Divorce costs range from extremely expensive to extremely reasonable, depending on the complexity of the legal issues and the conflicts among the parties. It’s always cheaper for husbands and wives going through a
divorce if they approach their case without hostility. That can be hard when each party brings a list of complaints to the negotiating table. Often those complaints are coupled with anger and frustration-it’s not unusual for both parties to believe they are the “victim”. Those cases normally are harder to settle and require more legal and court time and hence are ultimately more expensive. Long ago, when I sought advice from one of those experienced lawyers about the cost of divorce he said “Do
you know why divorce is so expensive? Because it’s worth it!” He was half-joking, but when couples are upset, and they don’t see a way of cohabitating any longer, are losing sleep and have lost hope as well as appetite, then they will realize the cost of the divorce is well worth it. They can reduce those costs significantly by attempting to reach an agreement. Sometimes an agreement for whatever reason can’t be reached and litigation is warranted.
